LAST WILL AND TESTAMENT OF ROSINA RUFENACHT

I, the undersigned, ROSINA RUFENACHT, also known as ROSIE RUFENACHT, widow of Walter Rufenacht, being 63 years of age, residing at Salt Lake City, State of Utah, realizing the uncertainties of life, and being of sound mind and disposing memory, and not acting under any fraud, menace, duress or undue influence, do hereby make, publish and declare this instrument to be my last will and testament:
I.
I hereby revoke and cancel any and all former wills, testaments, codicils and testamentary instruments of every kind and character which I may heretofore have made.
II.
Upon my death I direct that my body be decently buried beside the body of my deceased husband in the Salt Lake City Cemetery, and that funeral services be held and burial be conducted in accordance with the custom of funerals among the members of the Church of Jesus Christ of Latter-day Saints.
III.
I hereby nominate and appoint my daughter Sabina Frieda Rufenacht (who is generally known as "Winnie" Rufenacht) to be the executrix of this my last will and testament, to serve and act without bond.
IV.
My living children are named as follows: Werner Rufenacht, a son; Sabina Frieda Rufenacht (Winnie Rufenacht), a daughter; Mary M. Rufeancht, a daughter; Walter Rufenacht, a son; and Robert Rufenacht, a son; but inasmuch as my daughter Winnie Rufenacht has provided for my care and support so generously for a number of years, I deem it fair and just to leave all of my property to her upon my death, after payment of all of my just debts and charges; and subject to the payment of said obligations, I therefore devise and bequeath to my said daughter Sabina Frieda Rufenacht, also known as Winnie Rufenacht, all of my estate at the date of my death, both real and personal.
V.
It is my hope that my said daughter shall give to my other heirs out of said property, such part or portions, if any, which she may deem to be in accordance with any wish I may express after date of this will, but this provision is not designed to grant any other heir any interest in my property, for it is my intention that my said daughter shall have all of said property and shall give to any other heir only such property or proceeds which she may think appropriate, but without any legal obligation to give any part or portion to any other heir.
IN WITNESS WHEREOF, I, the undersigned Rosina Rufenacht, also known as ROSIE RUFENACHT, the testatrix, have hereby signed, published and declared this instrument containing two pages including this page, as and for my last will and testament, on this 15th day of February, A.D. 1945, at Salt Lake City, Utah, in the presence of Paul E. Reimann and Maybeth Farr Reimann whom I have requested to become and act as the subscribing witnesses hereto.

We, the undersigned PAUL E. REIMANN and MAYBETH FARR REIMANN, do hereby certify that on this 15th day of February, 1945, at Salt Lake City, State of Utah, the above named testatrix, ROSINA RUFENACHT, also known as ROSIE RUFENACHT, in our presence and in the presence of each other, duly signed and published and declared the foregoing document as and for her last will and testament, and she personally requested us and each of us to subscribe our names hereto as the attesting and subscriging witnesses, which we did in accordance with her request and in her presence and in the presence of each other; and we certify on this date that said testatrix is of sond mind and appears to be acting solely according to her own expressed desires.
